Another leverage you might have in getting a new phone is that refurb Moguls are on back order with Asurion. I had to wait more than a week to get mine. Just got it 2 days ago. Call *2 and let them know the situation and depending on who you speak with, they will probably give you a new phone.

It may also help if you already took your phone to a Sprint Repair center so they'll be able to see that also.
