Yeah make sure you get a clear one, but that still doesn't mean jack. I bought a 'clear esn" one and it happened to be active. (this was about half a year ago) Still have the brand new HTC Vogue sitting in my office ( I guess I should try to see if it is clear by now) but the seller misrepresented the item.
Just look at the sales rep at Ebay and see if they are in good standing. (then again some of them fall through the cracks, my seller was 99% good, but the accout was hacked)
