The thing is, we do have a license to Windows Mobile 5 (similarly, we don't have a license to Windows Mobile 6). However, by the same token, we aren't technically supposed to have AKU 3.x, since no provider (specifically our respective ones) has provided them to us.
My personal take on it is that I hold that I can move to whichever version of Windows Mobile 5 that I feel works best, and that since (at least in my case) it's purely for personal use only, I'm not taking this software and using it in a way for which it was not intended, and (most importantly) I'm not using up time that's paid support with people who aren't supposed to deal with what I'm doing, that I'm in the clear. Mind you, IANAL, and I have a deep suspicion that Microsoft, HTC, and Sprint (my provider) may not agree with me. But, everything I'm doing really affects only me, so I doubt they'll come knocking on my door anytime soon. (/me knocks on wood ![Wink](http://forum.ppcgeeks.com/images/smilies/icon_wink.gif) )

The part that they don;t agree with is the distributing of the ROMs. I am sure they do not care if you hack you phone into oblivion, as the user knows or will find out the hard way that opening up the phone viods the warranty. So, in essence we can still produce the ROMs, but they don't want the ROMs posted for the public.
