Well... whether or not what we're dealing with is bootleg software is still (imho) up in the air. I think this is a grey area.
The thing is, we
do have a license to Windows Mobile 5 (similarly, we
don't have a license to Windows Mobile 6). However, by the same token, we aren't technically supposed to have AKU 3.x, since no provider (specifically our respective ones) has provided them to us.
My personal take on it is that I hold that I can move to whichever version of Windows Mobile 5 that I feel works best, and that since (at least in my case) it's purely for personal use only, I'm not taking this software and using it in a way for which it was not intended, and (most importantly)
I'm not using up time that's paid support with people who aren't supposed to deal with what I'm doing, that I'm in the clear. Mind you, IANAL, and I have a deep suspicion that Microsoft, HTC, and Sprint (my provider) may not agree with me. But, everything I'm doing really affects only me, so I doubt they'll come knocking on my door anytime soon. (/me knocks on wood
