Here's the cab that I had to dl from sprint today as I needed the update version.
After you dl it on to your pc, change the file extension from zip to cab, dl it onto your touch and then execute it.

So it looks like they can tell if you are using an unauthorized version.
But it should be free for you since it comes with the TOUCH and you have the sero plan. I can see Sprint charging if someone used it on the Mogul since the mogul never had it.
Contact Sprint if they charged you.
