I would think more device specific or something interconnected with device specificity. I have an evo and am in good 4g areas, but still feel throttled, but I also have a sprint 4g wireless adapter and it uses wimax also but laptop has no issues hitting 13 or higher on the down. I think I have seen t close to 5 on up a few times using the sprint adapter. And even with wireless tether and /or hotspot, I still cannot get great speeds on my laptop until I do wired tether and then the 4g on my phone works awesome as my adapter for the laptop
