I do have the old bootloader. It's essentially stock, since the only thing that's ever been able to work is stock roms and the relocker. I feel like they're locking refurbs so people can't mod them. Nothing im trying seems to work.
I can't run 2.40 Hard-SPL. It doesn't work. It brings up the error 262 screen: utility has encountered communication errors during the update process. I've tried it from the bootloader and from the home screen. Same thing. Do i need to disable WMDC or something?

There was something in one of the threads about Vista machines needing new drivers or an upgraded WMDC from Microsoft. You could give that a shot. That does not explain why you cannot flash from the SD card however.
Another option is there are strong rumors that the official update will be posted on the HTC site on the 10th. If you cannot flash that, you have a legit reason to take the Mogul back to the Sprint store for replacement.
