Exactly, that is the whole debate regarding this fee, and why so many people hate it.
On the other hand every cell company has in their agreement that they reserve the right to disconnect abusers but with sprint 5gigs is not considered abuse and with tmo at 5gigs they throttle. Thats all I'm saying. Check article below, sprint has never advertised this:
