It's up to the AV vendors and their users. The detection is either a chance signature match, or more likely, a generic heuristic behavior hit.

Antivir no longer detects it because I submitted it to them as a suspected false positive. Their analysis confirmed this & it was excluded from their detections. Other folks should do the same if their AV vendor flags it. Some AV software provides an automated way to do this. If not, 60 seconds on Google should turn up the proper page/address for a particular vendor.
