Not exactly...if you remember sprint is also theoretically distributing it with every winmo upgrade...because from perspective only people with a license for it will generally be bale to use it anyways....since you have a license for it on the device M$ doesn't care and looks the other way...now if you tried to put it on a Android device...thats not making M$ any money..so it'll be a matter of time till there is a law suite for damages.

No its not theft..Tethering is not against the law..at WORST sprint can suspend your contract and thats it..even if I came up to sprint and told them i'm tethering and did it right in front of them there is nothing they can legally do about it, on the other hand if you put winmo on an EVO in front of M$ you'd get sued..same way as installing windows if you didnt buy it on your pc.
as for tethering..its like sprint has a backup option for $2 a month..so your saying going around and making backups for free is not allowed? Your mixing up violating copyrights/patents/trademarks with breach of contract punishable only by suspending of the contract. And realistically the programs to tether are on the Android Market place....if sprint wanted to they could have blocked them....
