How are you trying to install it?
I just installed it on 3.8x (as far as Angry Birds is concerned it's the same as 3.8 )
I installed it fine from the Market and then from TiBackup. No issues.
The Market has been wonky the past few days. I read it was having issues due to the 3.30 leak.
If you are tying to install it from a TiBackup file-did you dl a copy of BusyBox? That might help.
OMJ-sorry Bro-tried 3.8x to test 4G and wireless but even though 4G is now in Tampa I cant get it in the house
