Really depends on the tech. I had a bad keyboard on my TP, they offered a TP2, Moment or BB. I took the TP2

Since you've never used your TEP (I hadn't either) they'll probably offer a TP2 or similar. Go into a repair facility and just be nice - don't mention an upgrade or anything, let them offer it to you.

If they don't offer the upgrade, take the refurb'd TP - more likely than not it'll be screwed up, and then you have some ammo to talk to a manager with!
