because as far as my specific job goes, we were informed by our "regional trainers" that cloning your own ESN was fine, its just when you grab someone elses that it becomes illegal (like with burning your own CD's/DVD's for example).

The federal law prohibits the cloning of ESN and many state laws prohibit tampering with the ESN unless you are the manufacturer...
If you can somehow convince HTC to change the ESN with 2 devices then that is legal...if anyone other then the manufacture does the change..its illegal...even if someone does the ESN change on the device, it is illegal to be in possession of that device altogether.
If you have to blame anyone..blame the jerks who tried to make easy money by stealing others ESNs through cloning...
