ok after a hard reset I found out it is actually the wireless sync taskbar at the bottom that is causing this. It actually is the upgraded wireless sync, as when I did the hard reset is was gone, then as soon as I did a wireless sync it forced me to upgrade and soft-reset and poof there the damn bar is!

My plan now is to remove wireless sync and go back one version...
