UPDATE:
Just got off phone with sprint, she's going to call me back in a minute. It sounds like they are going to replace the device. She was updating my shipping address (I hate moving) then call me back to send me a replacement unit. I recommend anyone with this problem call sprint, after you get a service rep tell them you need to talk to a service technition about your phone registering touches that aren't happening. Tell them you know (because I know) there are no open tickets so far of this problem and that it appears to be a small handful of people having this problem, and you are one of them.
