thanks for your responses!! so i finally got an answer from sprint worldwide support. the $40 plan is avaiable HOWEVER, she said the plan must be added prior to 7.11.10, as the plan will be "decomissioned" on that date and will no longer be available after that. without the plan, data is .016/kb. just thought I'd share the info i received. i will add it this week.
