Yes, but if he used a second line to get the upgrade and ONLY activated it on the first that would not void his rebate.

For example, I have a family plan with 4 lines. My line is not eligible for rebate until next year sometime, but my son's line is and he doesn't want/need a new phone. I use his upgrade and activate it on my line, same plan so its all good. If the phone is not first activated/swaped on his line it doesn't create the scenario of 'swapping'.
