Same rules apply @ Best Buy that they do at Sprint...you get 30 days to use the phone and if you don't like it then bring it back...one problem though, you must bring it back in the same shape you left with. I cannot see Best Buy allowing you to return it in any way. They will look over the phone for sure and it's not like you are gonna have some idiot kid who doesn't care at the customer service desk...It's gonna be a BB mobile guy and I am sure that he/she will look it over....Go on the Hero forum and ask anyone that had to return their phone for one of the many issues upon release and I bet they all say that the store looked it over to make sure there was no damage....Best of luck to you but I don't see how or why Best Buy will/should be responsible because someone else is gonna end up buying that phone and why should they be stuck with a scuffed up phone?
