Now, if Sprint had said, "hotspot add on required for another device to access the Evo's data connection" then you would be correct. but they didn't say that. They said "hotspot add on required to access the device's WiFi" which is not good at all.

exactly the modem built into phone is what access wifi, not anything that sprint puts into the phone. Which is why even if the phone is not activated you can still access wifi. Sprint has no way of blocking out wifi access to wifi access points like starbucks or a home network.
