It is a binding contract but I don't think you can sue. Like what ajac said all you can do is file an unpaid dispute and resell it or you can do a second chance offer and sell to who ever came in second place. Thats why when it comes to some higher end merchandise you can set up certain stipulations like having the bidders pre-screened or have them pay a deposit and if they win the deposit becomes non-refundable if they refuse to pay for the item and who ever bidded but didn't win would just get back their deposit. Thats a good way to weed out the posers.
