IMHO, this might be the case 99% of the time, but they might be in the wrong if they somehow give the employee a "reasonable expectatiion of privacy" by doing, saying, and/or not doing something. If they knowing let the employee use it for personal calls and don't somehow give the employee notice that the calls are recorded, then we might talking about a Wiretap Statute Violation (Federal and/or State). That would be a Felony, and grounds for civil liability.
