I believe there are more legal issues than anything, custom roms are one thing, but each windows mobile phone has a built in cost going to M$ for a user liscense. Android and ubuntu etc are open source and free use so there really isn't any legal issues there but doing the reverse with out paying for a license would be right up there with ESN cloning and other illegal type activities.
