When you purchase a phone from a corporate sprint store, its their responsibility to ensure that it is free of manufacturer defects, and will warranty replace it.

If you buy a phone at a third party retailer (radioshack, best buy, etc.) it is the responsibility of the VENDOR for 30 days, after which liability falls back to Sprint. Radioshack and best buy purchase the phones from sprint, not htc directly, and within 30 days, they will replace it but, after that, sprint is in control for the next 11 months.

BTW, sprint has no way of knowing where you got the phone from.
