I did a little digging. and found this.

Federal Register/Vol. 71, No. 227/Monday, November 27, 2006/Rules and Regulations.

?201.40 Exemption to prohibition against circumvention.

(5) Computer programs in the form of firmware that enable wireless telephone handsets to connect to a wireless telephone communication network, when circumvention is accomplished for the sole purpose of lawfully connecting to a wireless telephone communication network.

No how hard it will be to get you ESN moved over I don't know but the law appears to be on your side.
