Your position will show up inaccurately when you have your GPS turned off because it can only use aGPS (assisted GPS) until the GPS is turned on. Why not just leave it on at all times? If you'll notice, when you first run maps it will show your location a tad off from where you actually are until it gets a real lock and jump to your exact position. The first inaccurate location is triangulated by cell towers to give the real GPS a head start and speed up lock times.
Also, Google Earth has been having issues with the update. That's why I didn't install it yet. I'm sure they come out with a fix very soon.
