My son has an HTC 6800 on Verizon without the data plan. Since he has WiFi available at work and home, it is not a big deal. He uses his phone to hold a database of customer preferences and contact info. He almost never uses data anyway.
He is in constant fear that it will break and have to be replaced with a "compatible device" that will require adding data.
Texting is a service that you are not required to pay for if you don't use it. Data should fall into the same category.

Data should but it doesn't and there is nothing you can do about it and is perfectly legal. You as the customer have the option to stay with them or not, just like you have the option to buy a smartphone or something like an envy. We can't tell Verizon what to do with their network we can only choose to pay them or not.
