if you have insurance, start the claim process, go as far as the page that tells you what replacement you are getting and if it says HTC 7380 jump on it, that's the TP2.
If it's HTC 6850 (TP) it will be a refurb and I'd be unsre about the reliability of a re-furb, seems like most of them have been through many customers hands and are all a bit weary now.

If it is a refutb TP or something else inferior, save your $100 deductable and go back to plan A, go into the store to see what you can get.
When you say claim process, is it the self service tool on sprint.com? If so, this message comes up:
