Tethering is not illegal. It is something that the carrier may not want you to do because they charge extra for it, but in no way illegal. Theoratically speaking if you speak to 90% of CS they will tell you tethering isn't possible without the plan.

There is not much a carrier can do to prove that you tether without violating your privacy. They do set that 5gb cap on some carriers and if you go over ti some have gotten warning notice. None for sprint so far.

And yes it is same as using a cable, if you use wmwifirouter for example it even runs ICS in the background. The HTC wifirouter while does not run ICS probably has ICS components built in.
