well, I where them with the earbuds popped out of my head. I've been pulled over many times, and only one co. sheriff 2days away from retirement asked me, "those things on your ears for talking on the phone?" this was after I knew i wasn't getting a ticket. (van in ditch)

I'm pretty sure as long as your not doing this while driving, you'll be fine. (again background noise may be an issue depending on which tin can you drive)
I can't imagine any prosecutor or judge caring about a measly 2-ear violation, especially since your supposedly being 'safer'.

(btw, I just wish the s9 had vibrate ring)
