I have dharvey program tab fix installed which puts the htc menu back in the tabs, you get the wm6.5 menu when you hit the win button. It is not required for the theme. The glass button is for the programs tab. I am assuming it works for the win button/htc menu if you don't install dharvey program tab fix.
The original is black background behind the program icon.
