Sprint has sent out letters in the past for people who roamed too much. You can search on Google for it. Usually they warn you if you roam too much (more than half your minutes roaming with 800min cap) a few months in a row (around 3) and if you continue after the warning, they ask you to leave, ETF-free. The data caps are supposed to be for the tethering plans, 5GB, 300MB roam, and the TOS used to say that, but they don't specify things so clearly anymore.
AFAIK roaming shouldn't be controlled by the radio. It should be controlled by the PRL. Probably the new radio is finding the Verizon signal stronger.
If you want to know for sure whether you are roaming type ##DEBUG# in the dialer and look for the SID. If it is 4000 or greater it is usually Sprint but there are exceptions. Many of the Verizon SIDs are less than 3999, but again there are exceptions. You can look up the SIDs here:

Roaming is something you don't want to do unless you have to on Sprint. It costs them real money and they do care.
