They are not misinformed. But Verizon cannot charge you extra for data because you dont have that plan - they can terminate you though and charge you the ETF fee, since you are using a data plan (tethering) for which you are not paying.

The majority of people that have tethered illegally and gone over the 5gb have had absolutely nothing happen to them. This is true. That does NOT mean that there is no cap. That does not mean that the $29 is truly unlimited. It is not. They don't put a number on it in their documentation because that is bad press - they would much rather be able to say "unlimited data" (with the hidden words being "so long as you don't violate the TOS by doing something that will use too much data, like tethering and things of that nature").

So, for those of you tethering without the tethering package, just don't go crazy. If you want to believe that it is unlimited, then by all means use 5-10gb a month. But be advised, you will not be doing that for long before you have to find another cell phone provider.

Lots of us have been tethering without a data package for years. Verizon could care less. But we're also not abusing it enough for it to throw up a flag. Once you throw up a flag and get Verizon to look at your account, they will quickly be able to determine you are tethering. So just dont throw up flags.
