It probably depends who you talk to. I called Wednesday night and was able to get a replacement phone, which shipped Thursday, so I'll have it Monday.

I originally had issues with battery life, and they shipped me a replacement battery. That replacement battery had the same poor battery life, plus caused my phone to overheat if using it while on the charger. When I called after that (Fri 10/23), they claimed they had no replacement phones and insisted on sending me a second battery. The second battery had the same poor battery life, but no overheating. Oh, and after that overheating issue, my phone started locking up occasionally, even after a hard reset. At any rate, the person I talked to Wednesday was very helpful and understanding. He agreed the phone was defective and had no problem ordering me a replacement. I'm curious whether I'll get a new one or a "refurb."
