I noticed thats only a problem on the newer UI builds. COM3, 4, and 5. COM2 and below does not have that problem or any of the other problems. Which further leads me to believe Microsoft is just giving us the runaround, sore about all the Chefs and Hackers and showing it by a mass release of new builds with problems..
RyanMogul6800 on XDA posted about some of the problems he found in the new UI builds. And by the looks of his skills I am pretty sure he has everything right so its a design and release problem on Microsofts end.

Problem 5 is acknowledging the theme alignment.
Reason people are using these new builds is because they love to have the latest releases regardless of the problems. I use COM2 and am very happy.
