i called customer service, and she said it was a possibility to go into the store and get an exchange, but the chick at the store said that the customer service reps shouldn't make "outrageous" claims like this, and then they gave me a new battery... still didn't fix the overheating issue, phone randomly hard resetting, or recessed volume and power buttons that get stuck in the on position when used... nevermind the 3 other replacements i've had for various problems. i sent them an email, i'm out of contract... i'll see what happens.
