He can sell it. As long as he's been charged already and it was only for one phone he should be fine. When the original Sprint Touch came out I called and ordered one thru retentions and they sent me 2 on accident. They charged me on the phone when I put the order in so I was only charged for one phone. I then sold the extra phone to my buddy the next day and he activated it just fine. I ended up getting the money back that I paid for my Touch plus I sold my Treo 700w and came out on top $150.
