You miss my point. The C&D is to stop distributing those apps, not the Rom. If the Rom contains the apps then he needs to remove them. Android the OS is open source, as I said call up the code and modify it. This case is a case of him violating their distribution rights and agreements. It does seem to go against open source, but one has to remember the apps cited arent part of the open source android.

He does not just wanna to remove the Apps. He want to quit the development. Maybe there is more to it than what we know.
Open source OS is not Open if there are terms like that. How can an Open source OS have boundaries and limitations? So I will say it again. Android is open source in theory.
