Re: Replacement Woes

Took my Calc exam... didn't finish the last 3 problems (but I had 6 pts extra credit, so it should balance out). At least there were about 50 problems

Anywho, no call from the Sprint supervisor yet.

Question: If I am in contract, who owns my phone? They said they sent a notice that the contract was being renewed... Both my dad and I can confirm that we received no such notice. If THEY agree to cancel my contract, can they ask for my phone back even though I purchased it under the false information that I would not be renewing my contract?

If the letter was not sent via registered mail and no one signed for it, it's not valid because they are saying my silence is acceptance of the new contract. Even if they play the "implied contract" game, there was no written portion nor a written confirmation on the terms of the contract, therefore the parole evidence rule doesn't apply. The statements they made to make me pay for the phone were misleading, as I was not told I would be entering into another service contract. Lets not mention that technically I'm not even authorized to make changes on the account. I only have the same last name.

I'll post more updates as they come...
