It won't be new but a refurb if they agree to. If you have TEP and $100 to spend I would drop it in a swimming pool and get it replaced that way. Tell them you dove into the swimming pool to save a some one drowning. Maybe they'll let the deductible slide.
Of course that someone drowing was your phone.
