The only rugged phones are nextel..and I have not seen any WM. As for replacement, Ive replaced phones free of charge, if its a screen crack they'll charge you because that means you dropped the phone or etc which is your rsponsibility but if you come in and say this doesn't work and I want you to "Repair" it. Then they would ask you if you want to upgrade and you tell them no. They will then usually replace it without bothering to repair it. If they tell you its gonna be 50$ to TEP just keep pushing them to "repair" it.
