Are you sure it's not your headphones? they could be shorted out...has been known to happen and has happened to me with about 5+ of the stock htc headphones....they're cheap and get worn out easily (just like all other headphones that come included with any electronic device).

If it's not the headphones, then it's most likely a common manufacturing defect (like on TP1 had the keyboard issue). If it is a hardware issue, the carrier will back it with the manufacturing warranty which is basically a free replacement within 30days, and then you get a refurbished phone after that.

I have had zero issues using the wired headset/headphones from my TP1. I do get the annoying issue of Voice Command kicking on with a normal headset though. I don't even bother using them, kinda defeats the purpose of the plug though.

Go to settings/personal/voice command and uncheck enabled
