It should still be a free repair or replacement because the phone should still be under the manufactures 1yr warranty.

If i continue to have issues with it and i decide to take it in should i remove all mods on it i.e. return back to completely stock unroot etc..

well stock cable sux and that was my port issue so i use a blackberry usb and that fixed mine. when i had the issue it seemed like port was loose and connection was lost if thats whats going on in your case.
