New Federal Law Allows Jailbreaking?

From the synopsis:

WASHINGTON – Owners of the iPhone will be able to break electronic locks on their devices in order to download applications that have not been approved by Apple. The government is making that legal under new rules announced Monday.
The decision to allow the practice commonly known as “jailbreaking” is one of a handful of new exemptions from a federal law that prohibits the circumvention of technical measures that control access to copyrighted works. Every three years, the Library of Congress authorizes such exemptions to ensure that existing law does not prevent non-infringing use of copyrighted material.
Another exemption will allow owners of used cell phones to break access controls on their phones in order to switch wireless carriers.

Pretty big if you ask me.

Lol. I wasn't aware that jailbreaking was illegal up to this point. :p

Although some of the other points are pretty big as well. Circumvention of copyright protection in video games and software? That's huge.

rooting is prbly legal but nand unlock is still warrenty violation

ether way it voids your warranty. Up till now it has always been illegal to "jailbreak" AKA "Root" your phone.

hence Warranty has nothing to do with legal.

Rooting is getting root access. In windows terms that would be you gaining administrator rights to your OS/system. In linux terms, is gaining Super User access to your OS/system, to be able to edit your over all files.

NAND unlocking is gaining write access to the portion of your ROM that contains system files. In windows terms that would be allowing your default installation system/windows directory and hidden files, to be over written, edited..

Since when has it been illegal to gain access to your OS/system files? To my knowledge it's frowned upon by those trying to deny you access to your system, mostly and basically because most people would end up messing up their system (phone in this case) if they don't know what they are doing and then they would not be able to assist you in fixing it afterwards, nor would they be held responsible. So you end up doing so at your own risk.

It's like cracking open your car's engine popping in a DIY turbo following some tutorial, online guide or youtube video, then when it doesn't work, you call the manufacturer for help.. They respond with.. Um sorry you're on your own.

EDIT: Jailbreaking is a totally different monster altogether. It does hold some legal discrepancies since it is partially circumventing protection implemented in keeping the device for use on the intended carrier, other than just allowing file access and installation of non-Apple or AT&T approved apps/uses... they do it more to protect their investment into the device then to deny you control over your device.

as mentioned before jailbreaking isn't illegal as far as city/state/federal law goes.... it was illegal in the eyes, for example, Apple
now Apple cannot say it is against their license for you to jailbreak their phone because Federal law now dictates that jailbreaking a phone is no longer a legal defense for Apple to void users warranties

at least that's the way I see it...

on a side note, I don't like when people use jailbreak as a generalized term for rooting, I think jailbreak should only be used to refer to rooting an iPhone or Apple product... let's use rooting as the generic term... again just my personal thought :)
