Microsoft issues take down notice for WM6.5.1 ROMs

WMPoweruser.com has an article up stating that MS has told XDA-Developers that they must take down all links to WM6.5.1 ROMs.

Ugh. I guess I better grab the currently finished 6.5.1 TP2 ROMs while I can in case they are taken down before unlocker is released.

Its crap. It always is. It happens every time the PPC world gets the newest and latest in handfuls. It has every time been a scam besides like twice that I recall. I wouldn't be too worried about because in a week or two everything will be back up and normal again.

Great example. Because we all know that Apple loves the idea of you running OS X on your Dell. [-X

XDA isn't even based out of the USA... They don't have to comply with takedown notices structured off of our laws...

Re: Microsoft issues take down notice for WM6.5.1 ROMs

Was wondering when this was going to happen...I don't see the threat lasting long as it would make alot of WinMo user's very unhappy. Not to mention alot of feedback they get from XDA and here at PPC as well. Going to be interesting how things work out though.

Yeah, M$ just probably wants to see how many donations they can get for themselves before they release it to the public.

Eh I bought a copy of Snow Leo just for it so its basically legal... plus its just a mini 10v. All the rest of my computers are real macs though.

Re: Microsoft issues take down notice for WM6.5.1 ROMs

Wait. I don't believe this is a legit request.

Where there similar scares with fake Microsoft legal notices?

No lawyer would cite US law out of its jurisdiction and demand action, as it would create a mockery of himself as well as the corporation he represents.

I feel like calling BS on this one. For the sake of community development, I hope I'm right.

This is fake again, i guarantee it. The last few times this has happened its been fake. I wouldn't get too worried about it.

I like this. Basically legal. Sure it violates the EULA completely, but it's basically legal. :joker:

I'm not judging, just find it funny that you'd use the most controlling company as an example of more open practices.

Not gonna deny they are VERY controlling but I had ubuntu on it for long time but needed iphone SDK on the go so why not?

Back to the subject at hand...

While these particular notices may or may not be actually legit, the above isn't entirely true either. This is really the entire point of the Digital Millennium Copyright Act and its accompaniments; the reciprocal recognition of copyrights. Hosts and registrars worldwide are still administered by ICANN which was also a party to DMCA development and can provide a whole set of other problems for companies that choose to completely ignore or provide proper channels for DMCA takedown notices.

I stand corrected.

But - do you think its likely they will encounter trouble if they didn't comply? I didn't even hear ICANN mentioned in anything around thepiratebay case.

This is interesting. It's like they feel as though everyone has beta tested 6.5.1 enough and it's time to say "hey thanks for working for us for free on this, but eat crap"

I do wonder though, if our computers were the same way, would we feel right about installing windows 7 when our computer came with XP? :/

blkout01 10-28-2009 07:29 PM

Re: Microsoft issues take down notice for WM6.5.1 ROMs

Did someone cry wolf? As much as it seems the companies would like to stop releases of these they can't afford to. As it was posted earlier in this thread they look at all the development and testing done here and use it to try and better the products. Ok well maybe they can afford to but it would make no sense.

Some sites offering ROMs based on Windows Mobile 6.5 got take down orders last week. They, However, appeared to be hoax.

“Taking action against sites such as XDA-Developers isn’t a matter of concern for Microsoft” says Maarten Sonneveld of Microsoft Netherlands against tweakers.net. “What happens there, the modifying of ROMs, is illegal. The intellectual property however is not with us. The ROMs are intellectual property of the producers of the phone or the mobile phone providers if it concerns branded telephones. We simple only deliver the OS.”

I am curious why would Microsoft give freely SDK tools and then if we choose to use them creatively they would choose to shut down all the free beta test and guinea pigs who load it and either like it or request fixes pretty cheapway for R +D. with no recourse.

I tend to believe this to be boggess

Link to SDK tools and Emulators free to download and use freely

Re: Microsoft issues take down notice for WM6.5.1 ROMs

I agree that it would be suicide for Microsoft to do that...a HUGE portion of their base uses custom roms and other stuff mostly since the fact that the devices we get are so limited...doing that would be equivalent to saying "Swap to android"... Theoretically speaking its these windows mobile communities that made WM what it is today.

Re: Microsoft issues take down notice for WM6.5.1 ROMs

ICANN is no longer under full US jurisdiction, and as such, the DMCA no longer applies to it.

It's bogus anyway.

Yep, with how slow Sprint is to give us upgrades for our phones and not being allowed to mess with WM6.5.1 ROMS...Droid will be running on devices that M$ never dreamed it would run. It seems like they would want us to push the bleeding edge.

I'm with the crowd on this one, calling "BS".
That takedown that was linked from wmpoweruser.com at XDA looked almost identical to a fake one last March. That lasted a day or two :)

It's fake. Microsoft would send a legal letter and not post on a website like that anyway.

This has happened before and it seems is happening again. I wonder if this 'Internet Investigator' (same title as the fake notices) used the same IP and email addy as before...

You make utterly no sense. Apple is 100 times more protective of their code, licensing and portability than Microsoft is. Does everybody that uses an apple product lose all common sense the first time they power it up?

Exactly. MS would NEVER post something so silly with so many legal ramifications to a public forum. The owners of the forum would be sent registered letters or served with a C & D. Anybody who wishes to think or argue differently is completely clueless. It amazes me how so ill-informed so many people are about things that are so simple. No wonder so many people fall for the nigerian email scams!

Well, I posted my skepticism here. I agree, too many people just assume this is true and don't follow up on it/question it. It's amazing how much fake authority we can instill in someone via an email in 2009.
