wow that is messed... i have been very lucky with my tp... it is an extremely good build. thank god u werent hurt.

I very highly doubt HTC manufactures their own batteries. The law suit would probably go out to whoever they contract for their batteries, much like the Apple/Dell notebook fires ended up in Sony's lap.

More pics would defenitely been good - just in case you want to file a law suit.
I completely buy the story: I have an Archos pvr. One day I took it out of the charger, which is also the cradle you have to use to watch & record. Since you program it to record on certain days, it's made to stay in there for days.

I took the thing out and almost burned my hand. Then I saw the battery door buckling. I finally got the thing open and the whole battery had expanded and pulled apart, being VERY hot.

I am certain that had I not taken it out, I'd be in the ashes of what once was my home and never guessing what caused it.

As far as lawsuits: you would of course sue the service provider. They are the only ones you have a servicable contract with. They in turn have a contract with HTC, which have a contract with whoever made the battery for them.

If you bought it through any one else, then you would sue HTC directly.

I don't think I need to file a lawsuit cause I really don't need the money cause I got a new replacement(Which sucks cause now I need to unlock again and reflash and try to find all my old programs I use) and my renters insurance covered the damages. If anything, instead of lawyering up for money, just try to get this out to more people(Like Engadget.com) and maybe instead of money, give us some damn graphics drivers for our phones that we should have gotten a long time ago.

if you check out my thread you can see the headach im going through, but you think if i called htc saying i was giveing my phone a chagre overnight to see if it solved my problem and i woke up to my smoke alarms sounding and a htc touch pro melted to my counter top they would send me a new one without me having to jump through hoops?

That's Sprint warranty policy for ya, even if its in one piece, they still wont help you out. Thats one thing I love about Verizon, they didn't even give me grief about giving me a replacement besides trying to make me bring in my countertop.

the way the us legal system works right now, the only way to bring attention to a defect that can literally kill people IS to sue them for money. there's no way you're going to sue for potential death from the phone catching fire, and come away with graphics drivers. on the other hand, you could probably sue for the danger that this phone put you in. personally, i would have verizon give me a different company's phone, such as the omnia, or something better, because honestly... if my phone caught fire, i definitely wouldn't want that phone in my house in the future. this is dangerous. i have 2 touch pros in my house currently, and both are in constant use. i'm starting to worry lol..

on the plus side, everything on your end is taken care of, and you seem like a honest person. most people would be talking to lawyers out of greed. i respect that, if more people were like you, this country wouldn't be the lawyer hungry spiral of back stabbing that it is.... but, this seems like a justified lawsuit. i would defintely talk a lawyer just to weigh your options, and potentially have htc pay back your insurance company, because its really htc's fault.

while people would like to blame verizon for their redesign of the phone, the fact is, it came out of an htc factory. if htc had better quality control, there wouldn't be two instances of houses potentially burning to the ground and people dying, which is eventually going to be the outcome. imagine if you had your phone plugged in, next to a window curtain or something.... you're asleep, your phone catches fire, by the time you are alerted to the fire, the fire has already breached the wall and the smoke is entering your 6 month old child's room.

this isn't about graphics drivers, or video performance, this is about actual lives. whether its 2 fires out of a 100 million, or 10, whatever... each time this phone catches fire, lives are in jeapardy, and its something that needs to be corrected by htc before people die.

Yeah, you got a good point there. I am actually going to sell my TP on craigslists and go back to my Alias. I like Windows Mobile phones but with the way the market is and how manufactures act around their products, I am ditching WinMo for the time being until everything is straighten out with their products. How hard is it to develop a software and hardware platform that work? I love this board to tears but we shouldn't have to waste out time trying to make an interface work, develop non-existant drivers or fix inherent glitchs in WinMo and the hardware. We should be focusing developing new programs or games for our devices, not fixing it. Maybe WebOS or Android could very well be the answer to WinMo's problems and to take on the iCrap's all around capabilities.
