so i had to take a different route to get a replacement.. apparently the store i went into yesterday in another city, was willing to swap out the phone for a new one but they didn't notate my account.. so i get to knoxville and i went to another store and they told me that i would have to wait until monday to have a tech look at it...

i didn't wait until then so i had them bill me a brand new pro to my account and i will deal with them on monday...

I just noticed this same problem today. Luckily I am still within my 30 day return for Best Buy. Hopefully they don't try and hassle me too much.

My sprint store looked at my phone for about 5 min and ordered me a replacement for the rainbow issue. I'm not sure if it will be new or referb. If it is referb, I can look at it and decide to decline it if I'm not satisfied with it. Some people have been complaining about yellowish screens on there replacement phones. If that is the case (or something else, I'll just decline it, and keep mine until/if my screen just gives out.

I had the Rainbow spot, and last night it became the rainbow square and the touch screen stopped functioning. I'm using My Mobiler right now to grab some text and some unsaved numbers out of the call log. Luckily I called almost two weeks ago to get an advanced exchange from Sprint and last night they said that they were in the warehouse and I would be shipped on Monday.

Why is everyone so worried about Refurb? I have never had a problem with refurb anything.

I had the same problem. The Sprint Store actually had TPs in stock, but they said because my phone was still technically working, they wouldn't give me one on the spot as a replacement. They placed an order for a replacement.

I doubt it'll be refurbished; the phone is still relatively new, and it's quite early for refurbs to be available.

You will probably get a used or refurb. There are thousands of returned Sprint Touch Pro handsets. Many people returned them because they just didn't like it, within the 30-days.

There are hundreds of others returned for d-pads, chrome, and other defects, that HTC could fix easily.

Question is, would HTC mark the 'Refurbished?' line in the phone's memory?

I believe that if they don't mark refurbished, they are violating some part of an FTC rule. I do know that they cannot sell a refurbished item as new though.

Most likely it does have to be marked properly because otherwise it would be assumed as new [fraud]

but they straight-up tell you that you COULD receive a refurbished or used phone.

You would never know if your phone was used. I played with a couple in the store, and it's not like they were going to flag it or something... it was in there replacement "first come--first serve," pile...

True, but I would be shocked if they aren't required to mark the device as refurbished in some way, shape, or form.
