In addition to the obvious ethical issue that doesn't seem to bother some people, here's a more practical one. My understanding is that if you report the phone as lost or stolen, it gets flagged in the system and can't be activated. So if that's correct, yes, you can keep your phone this way, but it'd be useless to you or anyone you'd sell it to.
