the question that needs to be asked here, is why do you need to be able to do this? im a law student in MI and can offer a little insight here..
if you just want to record convos between say like a fight between you and your girl to use later in a future argument, then legally your fine.. its not illegal to record a call.. its inadmissable evidence if your recording and you try to use that recording later as evidence to the police,judge;or jury.. so as long as your not planning on taking someone to court and using the recording, your all good.. if your recording your cell carrier(cust serv) convos(which could come in quite handy]then you need not notify them of said recording because they are already recording you, so it your right to record back for your personal records.. best of luck..looks like people left ya with a solution or 2program wise.. |

i used the voice recorder, but you can only hear your voice on the playback. the other person voice is not recognizable just alot of dead air. i had that feauture on a previous phone and it was cool. would love to have it on the TP. any good apps out there for it?

I've been able to capture entire conversations on grand central. Makes it nice since it records it in MP3 format.

The problem with native hardware voice recordings on WinMo is that the standard implementation of these devices is to use a modem chipset for the phone hardware. This chipset directly outputs to the speaker and inputs from microphone. In more recent WinMo devices, mostly WinMo5+, the hardware has been designed so that the microphone goes to the Smartphone first and then repeats to the modem. This allows software addons like AGC and Voice Command to work.
Just think of it like this - 95% of WinMo Phones out there are really just a PDA strapped to a very basic dumbphone SoC that passes commands back and forth via a COM port and there's a Terminal in the background running, whenever you have the cellular radio turned on, which handles commands and notifications. This is why some WinMo phones will suddenly wake-up. Depending on which SoC it uses for the dumbphone, it may or may not dismiss unknown interference that the radio receives. So if you are in an area with enough EMI the SoC may think some of it is incoming data and when WinMo sees those new characters in the Terminal it wakes-up immediately to begin translation. Well since it never receives a full command it just sits there and never pops up a notification. ------------------------------ Now here's the actual legal stance on call recording in (mostly) plain English: Twelve states require the consent of all parties to a conversation. Those jurisdictions are California, Connecticut, Florida, Illinois, Maryland, Massachusetts, Michigan, Montana, Nevada, New Hampshire, Pennsylvania and Washington. The remaining 38 states and D.C. permit individuals to record conversations to which they are a party without informing the other parties that they are doing so. These laws are referred to as "one-party consent" statutes, and as long as you are a party to the conversation, it is legal for you to record it. Nevada has an exception though. Nevada also has a one-party consent statute, but the state Supreme Court has interpreted it as an all-party rule. This means for legal use you must have consent of all parties, but for personal use you are fine. Also, many states do not protect the actual radio transmission of cellular calls. This means if you are broadcasting in unencrypted analog (usually when you're roaming) that anyone can grab that radio broadcast without repercussions because you are allowed to record OTA transmission for personal use (such as FM Radio or OTA UHF/VHF/DTV). Most states, and federal laws, make it illegal to disclose or playback any recording to 3rd parties that weren't a member of the original conversation. So if you record a call with your friend where he talked about cheating on his wife, you can be sued (quite heavily in some states - as much as 100$/day since the date of the original recording) for playing that recording to the wife or anyone else. And last, the use of automated recording solutions leaves you liable to be sued by anyone that uses your phone. If you let someone else use your phone and they are not aware that they are being recorded you can be sued by that person and whomever they speak with on the recording. |
