just wondering why if sprint is only selling tp2s on a plan how come theres so many on ebay claimed "new"for about 400?

because these phones cost about $600 without contract. So getting them for about $400 is a deal.

I just sold one myself on ebay and it went for about $400.

I bought one, new, $370 on eBay. You have to fish it good to get a good deal. You can also try CraigsList.Org

i havent heard anything about only being sold with a plan. I got mine yesterday and they gave me the option to purchase it without a plan.
