did mighty give the ok for this... he was told to take down and not sure without the ok from him that this would be a smart idea if microsoft or something saw his work once again hosted on the boards. wanted to throw my 2cents in and if it is ok i got everything that you guys will need i feel :)

Dude:laughing3: A. its fake :spam1:B. there is no way microsft would go threw the time to take down something like that becuase they no that someone will just load it back up somewhere else like umm idk megaupload, rapidshare just to name a few. i can tell that within 5 days everyhting will be back to normal and will hear about on the ppcgeeks podcast :) which btw i enjoy listening to at work

It's still wrong to upload someone else's work and then post a new link unless you have their permission.

like i said, i have PM'ed him now. im not uploading it to be unjust, unfair, or whatever. im just a huge mightyrom fan and like other fans would do whatever i can to keep his stuff circulating.

they would do it and they have in the past for real...... why would you risk getting in major trouble with someone like microsoft until you know it is official..... i say wait it out mighty and we will all be here by your side when you feel comfortable doing again.... everyone has to think of what mike could be thinking on this to and not what you think because you want to flash the rom that he has made..... think of others first and their well being guys especially with this being the holiday season... you got my support and anything i can do for you just ask brudda and consider it DONE.|

How is it wrong to mirror someone's work? It's not like he's not claiming it's his own work

because mightymike asked personally for it not to be mirrored so he could keep track of download totals and such. many chefs and creators ask the same so they have some numbers to work off of otherwise it wouldnt be close to being right

Going against someone's wishes doesn't make it wrong. No matter what you do, you're pretty much always going to be going against someone's wishes. I bet someone wishes somebody would upload a mirror right now, but everyone is going against that :D

Not saying that people's feelings don't matter, but mighty is the creator of this, and he has the right to make that request. If he asks that no mirrors be made, then none should be made, regardless whether it'll go "against someone's wishes."

Not speaking on official word or anything, but takedown notices unfortunately have to addressed in a "act now, ask questions later" fashion.

I personally believe its a fake, but you always have to take precautions when dealing with these matters. If its fake, the person can be sued for impersonation and other legal BS.

That's a terrible comparison. What the hospital would be doing is against the law. As much as he might want it to be, going against MightyMike's wishes isn't illegal. Maybe it is up in Canada, but not here on the interwebs :)

Just don't screw with other people's stuff. It IS against the law for you to distribute something that someone has created and asked you not to distribute. Hence takedown notices... Even if the creation is not copyrighted/trademarked, it can still be proven to be his creation and it is the creator's right to dictate distribution. This applies to many things. Mike has distribution requirements on his creations and if they are not followed, that is infringement on his distribution requirements. He shouldn't have to go get his work copyrighted to stop idiots on this forum.

Just don't do it. If you do, you will most likely just get warned, and then banned if you continued.

They might be able prove it's their creation, but they can't do anything about it, not legally. That's part of the whole reason copyrights and trademarks exist, so they CAN do something about it

you guys amaze me about this controlling who downloads what from where, who are u guys? at&t? we all know im just trying to help people who may have gotten TP2 for christmas or new tp2 replacements somewhere to download the best rom on the planet, i take no part in claiming this as my own work, i have yet to recieve a msg from mighty, he knows nothing about me sharing it, or if he does he doesnt wanna comment IDK. if he is truely just wanting the totals of downloads and such www.adrive.com keeps the tally and i can relay it to him after his site is back up. personally, i think he is probably cool enough to understand his community coming together to keep his stuff circulating. bite me. im reposting links.

I call spam too. Did you see the email address at the bottom of the letter? Internet1@microsoft-antipiracy.com just looks fake to me. Seems like MS would have something a little more professional than "Internet1".

It looks like the domain is owned by MS, but the administrative contact is some outside firm, actually an ISP. It also is hosted in the UK with several other anti-piracy domains such as Adobe.

Wow. In all this arguing that has gone on about whether it can re-hosted without permission or not legally, has anyone ever though of what would happen if Mighty was pissed off about this? He might....stop distributing his ROM at all...since people won't follow his wishes.

As far as this thread is concerned, the official stance is

"Mighty has no official mirrors or such and doesn't know of the existence of any of them"

That's part of what I said. We have had this problem on XDA with AC as well. He took all his work away twice (once 'cause of GPL issues and once because of idiots stealing his work).

MightyMike has resolved the issues with hosting, and his site is back up and running. In lieu of these updates, I'll go ahead and close this one down. PM me if you feel this thread should be left open.
